What is the status of Social Security Disability hearings?

For those of you who will have a review or are in the middle of a disability review and you want to keep your benefits.

There are three types of hearings;

  • In-person with a judge
  • Video hearings
  • Telephone hearings.

The benefits of going in person are that the judge will be able to see you. But you’re required to wear a mask, and you have to be behind Plexiglas. If you want to have your face and expression communicated, you are better off choosing the video option. Technology is getting good reviews because it is easy to use, and you can do it from home. This option gives room for the judge to interact with you, so that’s something to consider.

Then there are telephone hearings that are still in place, so you can pick the type of hearing that you want. If you have a good case, your medical evidence is there, and you have someone on your side who knows how to explain your limitations. Consider your hearing options.

My next point here is about telehealth and how it impacts your ability to get and keep your benefits. Judges are looking at telehealth with less value than going to a normal doctor. A few things to consider here.

If you are using telehealth, there’s the option to get back into in-person health. I would encourage you to consider in-person care, especially for physical conditions. I mean, if you can’t get there and it’s for your brain health like PTSD, depression, or anxiety. Those are more favorable from judges. You can still use telehealth, but if you got a bad back or dealing with an autoimmune condition. In-person visits would be your best way to get treatment.


As always, after you go to your treatment remember to check your notes. Check the doctors’ notes and make sure that they’re recording what went on with you and what your limitations are.
